TOWERS RACING PRODUCTS BUSINESS POLICY

GENERAL:
Towers Racing Products. (TRP hereafter) is a Texas Business located at 601 North Highway 95 Granger, TX 76530.  TRP is open M-F from 8AM-5PM (CST)-Central Standard Time.  TRP is closed Saturdays, Sundays, and all legal holidays.  Specifications, kit, operating procedures, and/or parts availability subject to change without notice.  However, you will receive notification of any changes on an order prior to shipment.  TRP is not responsible for any unintentional omissions or typographical errors.  Your information will never be resold to third parties and is used internally to improve the quality of service only.  Please read the TRP privacy statement for complete information.

DEALER INQUIRIES:
Dealer inquiries are welcome.  To become an authorized TRP dealer you must follow these steps:

  1. Call Towers Racing Products and speak with one of our sales people and they can assist you in processing your dealer application.

BACK ORDERS:
All orders which cannot be filled immediately will be placed on back order status.  If this occurs, TRP will notify you and give you the option of waiting until the order is filled or canceling your order.

PRICES:
Prices are subject to change without notice.  However, you will receive notification of any changes on an order prior to shipment.  Prices do not include applicable shipping, handling, or duty charges.  

PERFORMANCE CONSUMER'S BILL OF RIGHTS:
Legally, a vehicle manufacturer cannot void the warranty on a vehicle due to an aftermarket part unless they can prove that the aftermarket part caused or contributed to the failure in the vehicle (per the Maguson Moss Warranty Act (15 U.S.C. 2302(C)) . For best results, consider working with performance-oriented dealerships with a proven history of working with customers. If your vehicle manufacturer fails to honor emission/warranty claims, contact EPA at (202) 260-2080 or www.epa.gov.  If federal warranty protection is denied, contact the FTC at (202) 326-3128 or www.ftc.gov.  For additional information, check out the following links:

OFF-ROAD ONLY ITEMS:
 Some items sold and/or manufactured by TRP are not CARB approved for sale, installation, and street use in the states of California , New York , New Jersey , and Oregon .  In these states, such items are legal for use on racing vehicles only which may never be operated on public highways.  Some items sold and/or manufactured by TRP are 50 state CARB approved for use on public highways.  However, you should check your local laws before ordering and installing any questionable items.

SHIPMENTS:
 All orders are shipped FOB shipping point Granger, Texas .  All orders that are placed Monday-Friday by 3:00 PM (CST)-Central Standard Time for in-stock items will be shipped the same day (date of shipment not shipment method).  All other orders will be shipped the next business day (date of shipment not shipment method) or when item(s) for the order become available.  TRP reserves the right to ship partial orders.  If additional orders are called in the same day your order is placed, TRP cannot guarantee that all items will ship with the original order or that additional applicable shipping and handling charges will not apply.  TRP cannot guarantee the availability of any items.  All items under 150 lbs. are shipped UPS ground unless otherwise specified at the time of ordering.  All items over 150 lbs. are shipped by truck.  Special second day air and next day air shipments are available at an extra charge when your order is pre-paid in full prior to shipment.  All orders are subject to an $8.50 packaging and handling charge.  All shipments outside of the USA require pre-payment in full using US funds.  All drop shipments are subject to a charge of $25.00. Dealer/distributor orders of $2,500 or more qualify for free freight (FOB shipping point Granger , Texas ), some restrictions may apply, contact TRP sales department for details.

REFUSED SHIPMENTS:
All customers which refuse a shipment are subject to a $25.00 processing charge, to and from shipment charges (including packaging and handling), and any applicable charges or penalties made by the freight company.  These charges must be paid before any further TRP orders are processed.

RETURNS:
All items to be returned must be approved in advanced and accompanied by your RGA (return goods authorization number).  All returns must be made within 90 days of the original shipment date. All returns may be subject to a restocking fee up to 25%.  The balance will be returned in the form of a check or may be applied as TRP credit towards another order.  Special orders and electrical components are not eligible for returns.  In-bound freight is always customer's responsibility.  If you need to return an item, we recommend using major carriers such as Airborne Express, Federal Express, UPS, United States Post Office or mail and pack companies such as Mail Boxes Etc.  Before returning an item, be certain it is packed in a protective carton with the RGA number on the top and two sides on the box (save your original packaging for this purpose).  If needed, TRP can supply you with premium packaging materials (at customer's expense) as in-transit damage is not covered by the Towers Racing Products limited warranty and liability agreement.  TRP recommends that you insure your shipments for full replacement value.

INSTALLATION NOTICE:
TRP is proud to offer professional installations, which are consistent with our high standards.  All installations and/or custom projects are available by appointment only and require a 100% pre-payment in U.S. funds (please call for additional information).  TRP will install only CARB approved items on pollution controlled motor vehicles unless the following criteria is met:

  1. The vehicle to receive installation service is delivered to and transported from TRP without front and/or rear license plates on a vehicle trailer.

  2. A waiver is signed by the customer stating they understand and will comply with the following terms:

  3. The items purchased and/or to be installed by TRP are not CARB approved or legal for sale, installation, and street use in the states of California , New York , New Jersey , and Oregon .

  4. The installation if such items will render their vehicle for racing purposes only, which may never be operated on public highways.

  5. The installation of such items may render their vehicle non-tail pipe emissions certifiable and violate emission laws, the vehicle codes in their state, and The Clean Air Act.

  6. TRP will not remove, modify, or tamper with in any way emission control devices.

  7. The customer, and not TRP, will accept full legal responsibility for failure to comply with their state's emission laws, vehicle code, The Clean Air Act, which may include but is not limited to severe legal fines, penalties, and prosecution.
